WILLS & ESTATES
Harris Lieberman has a long tradition of providing excellent service to our region’s residents in planning their affairs for infirmity and death, and in assisting their loved ones to manage their affairs after their death.
When assisting our clients with their estate planning, we take detailed instructions which help us to recommend the best structure for their estates following death. We take into account:-
- The needs of vulnerable beneficiaries;
- The difficulty of striking a balance between the conflicting interests of family members following divorce and re-marriage.
When disputes arise, Harris Lieberman has considerable experience in advising on and litigating estate disputes, particularly applications for family provision.
In the area of Probate and Estate Administration, Wendy Cleaver provides a highly professional service to Harris Lieberman’s clients. Wendy has been involved in the legal industry since the early 1980’s and has extensive experience in Probate and Estate Administration. Wendy approaches her work with compassion and sensitivity.
MAKING A WILL
A surprising number of Australians die without a valid Will in place. This means that their estates may not necessarily be distributed the way they would have wanted. You can avoid this by making a Will and regularly reviewing it.
At Harris Lieberman Solicitors we understand that making a Will can be confronting. There are often competing obligations which require careful consideration. Everyone’s circumstances are different and your Will needs to take your personal and family situation into account.
We will take the time to listen to your concerns so that, as far as possible, the outcome you are hoping to achieve is reflected in your Will.
MAKING A POWER OF ATTORNEY
Who would be able to act on your behalf if you were unable to manage your own affairs? This might be due to illness or injury, but it could also be due to other circumstances such as traveling overseas. You can ensure that the people you want to make medical, financial, legal and personal decisions on your behalf have the legal authority to do so by making valid Powers of Attorney.
It is important that the correct people are appointed to these roles. It is your decision and you need to have full confidence in the people you are appointing. Harris Lieberman Solicitors will explain the different roles and assist you to decide who would be appropriate.
The legislation covering this area of law differs from state to state. Harris Lieberman has operated on the border for over one hundred years, so we understand the particular challenges that these interstate differences can present.
PROBATE AND ESTATE ADMINISTRATION
Harris Lieberman Solicitors have been assisting their clients with Probate Applications and Estate Administration since 1886. Operating in both Victoria and New South Wales we can provide the kind of expert advice that people in our region need.
If you have been appointed as an Executor, or if a close family member has died without a Will, we can provide you with the legal advice and assistance you need.
We understand that this is a stressful time and that you may not have been in this position before. We will explain the process to you and keep you fully informed throughout.
Our experienced staff will make all the necessary enquiries and prepare the formal court documents that may be required. We can handle the administrative tasks for you including redeeming assets and transferring them to beneficiaries, making applications to superannuation funds, arranging for the sale or transfer of shares and acting for the Estate on the sale of property.
We pride ourselves on providing a service that is client focused, efficient and timely.
MAKING A CLAIM AGAINST AN ESTATE
If you have been left out of the Will of a close family member or if the provision made for you in the Will is less than what you had expected, it may be possible to you to make a claim. The law in relation to Estate litigation has undergone significant change in recent years and if you are considering making a claim you need to get reliable, timely advice.
Harris Lieberman Solicitors have a long history of acting for clients in these circumstances and can provide advice in relation to claims in both Victoria and New South Wales.
There are very specific time limits that apply in Estate litigation and so it is important that you get advice at the earliest opportunity so as to ensure your claim does not become statute barred.
Harris Lieberman can assist you by making enquiries and gathering information which will help inform your decision to pursue a claim.
Nobody wants to see their hard work squandered through a lack of effective planning. Even if you think it is too early for a succession plan, you can still plan for succession. This means taking some time to think about where you see your business going in the future.
Family farms present particular challenges as the needs and wants of multiple generations require careful management. Consideration needs to be given not only to the family members that might be looking to take over the farming operation but also other family members who may have different aspirations. How are you going to ensure that all the relevant parties understand what you are trying to achieve? What discussions do you need to have? Who should be involved in the decision making process?
At the end of the day you might not be able to please everybody, but a well thought-out plan will put you in a position to move forward with confidence.
Harris Lieberman Solicitors have for many years assisted clients to reach solutions tailored to their specific circumstances. We have the experience to work with you through this process.
